Aetna is fighting the suit.

"Dr. Iinuma's decision was correct," Aetna holds in court filings, which also state that, “plaintiff has asserted throughout this litigation that Dr. Iinuma had no medical basis for his decision that 2011 lab tests were outdated and that Dr. Iinuma's decision was incorrect. Plaintiff is wrong on both counts."

If the California investigation finds violations, the state's codes set monetary penalties.

This news comes against a backdrop of a massive deal by CVS to acquire Aetna, announced late last year.

Aetna chairman and CEO Mark Bertolini announced at that time that the deal “will have no immediate effect on your benefits,” adding that, “we will use CVS Health’s footprint of more than 9,700 retail stores and 1,100 in-store clinics to establish entirely new community health hubs dedicated to improving consumer well-being and answering questions about health, prescription drugs and health care benefits.”

“We think of it as creating a new front door to health care in America,” CVS Health’s chief executive, Larry J. Merlo, told The New York Times.

The deal, if it passes regulatory hurdles, will offer consumers a more “integrated” experience, claims the company.
